When an employee is a qualified worker within the workers' compensation system, his or her employer is required to pay for workers comp insurance. If the worker is injured on the job, s/he will generally be entitled to collect benefits through workers comp. The workers comp system is designed to remove an employers possible negligence as a factor when deciding whether or not a worker may collect benefits. In exchange for the simplicity of this system, the worker gives up his/her right to file a lawsuit against the employer using the civil court system, even if the employer is partially (or entirely) at fault for the accident itself.
