Generally the issues surrounding lunch and other breaks during the work day is addressed by state laws—not the federal Fair Labor Standards Act.  This section provides some general information on the subject; however, if you’re having a disagreement with your employer, it would be a good idea to confirm with your state labor or industrial relations department what your state law says about the right to take work breaks.
