Family And Medical Leave Act

The FMLA is a federal law that requires employers with 50 or more employees to provide their employees 90 days of unpaid leave for their own or a family member's serious medical condition. The leave provided under the FMLA is not technically a "benefit" but a right under law for some employees. This section describes who is elligible for the leave and your right to insist on it without discrimination.

FAQs

I am the father of a newborn and want to take time off to be with him during his infancy. Can I do this without getting penalized by my employer? My wife was able to stay home under her employer's "maternity leave" policy.

My supervisor told me that once I run out of FMLA time he is going to immediately fire me if I take any more time off. Is this legal?

I have a medical condition that is protected by the FMLA which often causes me to miss work, but my employer has a "no-fault" attendance policy that penalizes everyone for any absence regardless of the reason. If I have one more FMLA absence, I will be fired. Is this legal?
