My employer told me he would not fire me as long as I was doing a good job. Will this hold up in court? What if it is written in my employee's handbook?
In some states an oral contract is binding, and will be upheld in court. However, there generally must be some evidence that the discussion took place; in addition, the employer's past practices might be noted. A lawyer will be able to tell you whether or not your specific circumstances and evidence will be enough to protect you.
If it is written in the employee handbook, it will depend on the state you are employed in and how specific the wording is. Again, it is advisable to contact an attorney, who can interpret the language and any disclaimers in the handbook, to determine if the handbook would be considered to have created a contract.
