Firing

I work on commissions. My employer fired me and said that I am not entitled to any further commission, although sales I made are already booked but the payments from the customers have not yet been received. Am I entitled to these commissions?

The right to receive commissions for work performed before an employee’s termination is governed by contract under Pennsylvania law. If there is no expressed agreement or written compensation policy, the courts in Pennsylvania would most likely find that an employee is entitled to be paid commission on sales booked before the termination even when payment is received by the employer after the employee leaves. However, if there is an agreement or a written compensation policy which provides otherwise, that agreement or policy would control.
