I pay my medical premiums through my employer and now I find my company has not paid its insurance premiums and has filed bankruptcy. Is there any way to force my company to pay the coverage?
This is one of the circumstances where a lawyer is strongly recommended and and should be retained quickly. Wages owed, even if they are deducted for some other purpose, can never be discharged in bankruptcy. You also have a property interest in the insurance, and thereby, the coverage afforded. And you have also been defrauded: the taking of your wages and failing to pay the insurance premiums both sound intentional. If you file suit and are successful, the employer would be subject to punitive damages.
