California Harassment, Discrimination, Family Leaves (Paid and Unpaid)

A few short reminders about the number of employees threshold for application of California and federal discrimination, harassment and paid and unpaid family leaves which impact on an employer’s required posting requirements. Note the following:
- For Sex Harassment liability an employer need only have one employee
- For Discrimination other than Sex Harassment, an employer need have:
- 5 employees to be subject to California law; and
- 15 employees to be subject to federal and California Law (whichever is most protective applies to California employers)
- For Family Leave (unpaid):
- California Law requires 50+ employees within a 75 miles radius
- Federal Law requires 50+ employees within a 75 miles radius
- For Paid Family Leave (a newer creature of California law)
- Employers need only 1 employee
